Building Regulator Finds Numerous Flaws in Rosebery’s Toplace Jolyn Park.

A recent evaluation by the state’s construction regulator has brought to light considerable flaws within the Jolyn Park development by Toplace. This discovery has cast doubt on the future for those who have purchased apartments.

The Jolyn Park complex, located on Epsom Road in Rosebery, has been the focus of four regulatory inspections, resulting in a directive for remediation to address identified issues. A prohibition notice has been enacted, halting the issuance of any further occupancy certificates until the state’s approval to resume is granted.

Reports by the regulatory body have pointed out that the project’s shortcomings pertain to subpar waterproofing, fire safety measures & structural integrity. The responsibility to amend these issues falls on DVT Group, the overseer of Toplace since Jean Nassif’s management ended with the company’s insolvency earlier this year.

This site represents the tenth Toplace-related Sydney development to receive similar orders for rectification since 2021. Jean Nassif is currently evading fraud charges in Australia, with last reports placing him in a remote area of Lebanon.

The stipulation for Jolyn Park is a three-month window to rectify all defects, including any subsequent damage. Attempts to reach DVT Group for a statement on the order and their capacity to meet the deadline were not met with a response.

The approval for Jolyn Place’s development was granted by Sydney’s city authorities in two separate instances, during 2010 and 2016. The site comprises 266 residential units, 71 serviced apartments & commercial spaces on the ground level. Marketing materials for the units still on sale promote the development as a vibrant urban residence with distinctive appeal.

David Chandler, the NSW Building Commissioner, has warned that the necessary repairs could entail significant expenditure. Nonetheless, he notes that the costs incurred by the developer should be weighed against the advantages that occupants will receive from the remediation of these critical defects.

Another complex with rectification orders is The Laneways in Rosebery, which has load-bearing walls, a staircase and a car park ramp that are at risk of collapse. Owners of apartments in The Laneways have received orders from the NSW government that prevents them from living in the complex.
